The Privacy Policy below applies to you irrespective of where you are based. There are certain additional parts of the Privacy Policy that will apply to you where you are a resident of California. These additional parts do not apply to everyone.

FixDigital Ltd. (“we” or “FixDigital”) operates and manages the FixDigital system (“the system”). We respect the privacy of users of the system and will act to protect their privacy in accordance with the detailed privacy policy below and in compliance with the provisions of any law. We believe you have the right to know FixDigital’s policy regarding the types of information we may collect and how we use it when using the system and/or the services offered through us (“the services”). Please read this Privacy Policy carefully, which describes how we collect, use, and transfer information.

By using the system, this Privacy Policy is part of the general terms of use available in the system (“General Terms of Use”). Access to and use of the system, including the services offered through it, are subject to the General Terms of Use governing the relationship between FixDigital and you as a user, and your use thereof constitutes your agreement to the General Terms of Use and this Privacy Policy. Unless otherwise defined, terms defined in the General Terms of Use shall have the same meaning as described therein. FixDigital may condition access to the system or services upon registration that includes identifying information of the user and additional details at its discretion. If the user does not provide the data that is explicitly required in the system or otherwise, FixDigital may prevent the user from browsing the system, certain areas of the system, or using the services, at its sole discretion.

In the course of using the system or registering for the system and using the services, you may be asked to provide FixDigital with details about yourself, including full name, email address, phone number, credit card number, and other identifying information as required from time to time. You declare that you are aware that there is no legal obligation to provide this information to FixDigital, and that the information is provided voluntarily and with your informed consent. Additionally, during the use of the system or participation in the program, information may accumulate about your practices, how you use the system, details of the device and equipment through which you use the system, your digital identifiers (such as your IP address, MAC address, IMEI number, etc.), your location, products you have purchased, content or advertisements you have read in the system, pages you have viewed, offers and services that interested you, and more. In the course of making payments via credit cards, we may also collect details about the transactions you have made concerning the products we offer and your consumption habits.

During the use of the system, you may upload, store, and process personal information in the system regarding your data subjects. You are the owner of the database regarding this information and are responsible for ensuring that you use it in accordance with legal requirements and the rights of the data subjects, including obtaining their consent where necessary.

By registering for the service, you agree that the company may contact you regarding the service and send you email and SMS messages. We may retain correspondence and/or conversations conducted between us and you for customer service, management, and service improvement purposes. Upon registration for the service, the company will add you to our mailing list, so you will periodically receive updates and publications from us regarding promotions, services, products, and other information that may interest you. At any time, you can unsubscribe from the mailing list and direct mailing by sending an email to support@fixdigitalcrm.com. After submitting an unsubscription request, the company will cease sending you promotional materials.

The use of the information as described will be done only according to this Privacy Policy and for the purposes detailed below:

(a) To operate and manage the system, the program, and the services, including FixDigital’s sales activities.

(b) To provide you with service and maintain contact with you.

(c) To improve and enrich the services, including creating new services and content that match the demands and expectations of users and to change or cancel existing services.

(d) To extract from the information you provided additional types of information and characteristics about you, including regarding your areas of interest, preferences, and additional data as mentioned.

(e) To send you various content, including commercial offers from us, our clients, or our business partners, subject to your consent and provided that you can request at any time not to receive such content and messages.

(f) To tailor the advertisements displayed to you during your use of the system to your areas of interest.

(g) For direct mailing purposes based on profiling and segmentation of groups with different characteristics.

(h) For any other purpose detailed in the General Terms of Use of the system or this Privacy Policy.

The details and information about you will not be provided to third parties without your prior consent, unless permitted within this Privacy Policy, as updated from time to time. Notwithstanding the above, you acknowledge that FixDigital may transfer personal information to third parties in the following cases:

(a) To affiliated companies and service providers of FixDigital, so that FixDigital can provide you with the services, according to the purposes detailed in section 2 above.

(b) To its business partners and other third parties for sending marketing, advertising, and other materials that may interest you, provided that your explicit consent has been obtained separately for such transfer of information, subject to the provisions of any law.

(c) As required by law or order to disclose information to a governmental authority or third party, it may also disclose information as necessary for enforcing an agreement, filing a fraud complaint, or actions that may cause harm to us or others.

(d) If FixDigital believes that providing the information is necessary to prevent serious harm to your body or property or to the body or property of another.

(e) If it concerns statistical information about the use of the system or participation in the program, or any information that does not personally identify you.

Additionally, subject to standard confidentiality arrangements, we may transfer the information as part of our databases, to buyers and potential buyers of all or part of the activity, assets, or shares, including in the event of a merger with another company, as well as within negotiations and due diligence related to such transactions.

If information is transferred to third parties as mentioned above, it is clarified that these third parties may be located outside the borders of the State of Israel and therefore be subject to the privacy protection laws of other countries in the world, including countries that do not provide the same protection as Israeli law provides for privacy. Therefore, you explicitly consent to FixDigital transferring the information collected about you, in accordance with the privacy policy, also to these countries.

The data and information provided to FixDigital will be retained only for as long as necessary and reasonable for the purposes for which they were collected. Please note, anonymous or aggregate information may remain on our servers, and we may use it, among other things, for analysis and statistics purposes now and in the future without time limitation. You are entitled to request to review the information we collect about you and to request its correction if this information is not correct, complete, or accurate. Requests to review and correct information can be sent via a message through the system or by sending a message on the FixDigital website or by email to: support@fixdigitalcrm.com.

The system may use standard industry technologies, such as ‘cookies’ (Pixels, Cookies, GIFs, Web Beacons, etc.) (hereinafter: “‘Cookies’”) to store information locally on your device regarding your use of the system, all to make your browsing experience on the system simpler, more relevant, and more convenient. The use of ‘Cookies’ will be for the ongoing and proper operation of the system, including to collect statistical data about the use of the system, to verify details, to tailor the system and/or its content to your personal preferences, and for information security purposes. ‘Cookies’ are text files that your browser creates upon command from the system’s computers. Some of the ‘Cookies’ will expire when you close the browser, and others are stored on your device’s hard drive. If you do not want ‘Cookies’ to be installed, you can avoid this by changing the settings in your browser. For this, please consult the help file of the browser you are using on your device. However, please remember that disabling ‘Cookies’ may result in your inability to use some of the services and features on certain websites.

The system may include links to pages, applications, and websites on the internet that are not managed or operated by FixDigital or anyone on its behalf. FixDigital does not control or supervise such pages, applications, and websites, and the fact that FixDigital links to such content does not indicate its agreement with their content and does not constitute a guarantee of their reliability, timeliness, or legality. Use of these pages, applications, and websites is subject to the privacy terms appearing therein, and not to FixDigital’s privacy terms.

FixDigital does its best to protect the confidentiality of personal information by taking standard precautions and using information security systems to prevent unauthorized access to the information in its possession, including using encryption mechanisms customary in commerce, subject to the provisions of any law. The user is aware that FixDigital dedicates resources and takes standard industry measures to prevent intrusion into the system and to thwart potential harm to privacy. However, FixDigital cannot guarantee that the system and services will be completely immune to unauthorized access to the information stored by it, and subject to the provisions of any law, it will not be responsible for any damage caused due to intrusion into the information in its possession and/or unauthorized use of such information.

FixDigital may change the provisions of this Privacy Policy from time to time, including to reflect technological, business, legal, or regulatory changes. If significant changes are made to this policy, including regarding the provisions concerning the use of the personal information you provided, a notice will be published on the system’s homepage and on the FixDigital website at: fixdigitalcrm.com.

Collection and Use of Personal Data of California Residents:

This Section applies only if you are a California resident. For purposes of this section, “Personal Information” has the meaning given in the California Consumer Privacy Act (“CCPA”), the California Privacy Rights Act of 2020 (“CPRA”), and any regulations promulgated under either law, in each case, as amended from time to time.

Right to Information/Know You can request whether we have collected your Personal Information, and in certain cases, the following information about how we have collected and used your Personal Information during the past 12 months:

The categories of Personal Information we have collected.

The categories of sources from which we collected Personal Information.

The business or commercial purpose for collecting, sharing, and/or selling Personal Information.

The categories of Personal Information that we sold or disclosed for a business purpose.

The categories of third parties to whom Personal Information was sold, shared, or disclosed for a business purpose.

Right to Access. You can request a copy of the Personal Information that we have collected about you during the past 12 months.

Right to Correction. You can request that we correct inaccurate Personal Information that we have collected about you.

Right to Deletion. You can ask us to delete the Personal Information that we have collected from you.

Right to Opt-Out of Tracking for Targeted Advertising Purposes.

FixDigital does not currently sell Personal Information as defined under the CCPA. FixDigital may share Personal Information with advertising and analytics partners for cross-context behavioral advertising purposes, where applicable.

California residents have the right to opt-out of such sharing by email: support@fixdigitalcrm.com.

FixDigital recognizes Global Privacy Control (GPC) signals as a valid request to opt-out of the sharing of Personal Information for cross-context behavioral advertising purposes.

FixDigital may collect certain categories of Sensitive Personal Information (“SPI”), including account credentials and financial information necessary to process transactions. Precise geolocation information may be collected only where enabled by the user and required for the provision of certain Services.

FixDigital uses and discloses Sensitive Personal Information only for purposes permitted under the CPRA, including:

  • Providing and maintaining the Services;
  • Authenticating users and securing accounts;
  • Processing payments;
  • Detecting and preventing fraud, misuse, and security incidents,
  • Performing services on behalf of FixDigital through authorized service providers,
  • Maintaining, improving, and securing the functionality of the System, and
  • Other purposes permitted under applicable law.

FixDigital does not use or disclose Sensitive Personal Information for purposes beyond those permitted under the CPRA.

Right to Nondiscrimination. You are entitled to exercise the rights described above free from discrimination prohibited by the CCPA.

California residents may submit requests to exercise their privacy rights by contacting FixDigital at:

FixDigital will verify your identity before processing requests relating to access, correction, or deletion. The verification process may require you to provide additional information necessary to confirm your identity.

FixDigital will respond to verifiable consumer requests within forty-five (45) days of receipt. Where permitted by law, FixDigital may extend the response period by an additional forty-five (45) days and will provide notice of the extension.

Authorized agents may submit requests on behalf of California residents in accordance with applicable CCPA/CPRA requirements.

FixDigital retains Personal Information only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, enforce agreements, maintain security, and support legitimate business operations.

FixDigital’s policy is to not knowingly collect personal data from children under the age of 16.

Civ. Code Section 1798.140(v)). FixDigital has not collected Personal Information from California residents during the preceding twelve (12) months.
